Terms of Service

1. Who we are

Brace Builder is a website builder operated by [CYBERBRACE SYSTEM & TECHNOLOGY LTD], RC [NUMBER], [REGISTERED ADDRESS], Lagos, Nigeria ("we", "us"). These terms apply when you use bracebuilder.com, app.bracebuilder.com and sites hosted on bracebuilder.page or connected domains (the "Service"). By creating an account you agree to them.

2. Your account

• You must be at least 18, or the age of majority where you live, and able to enter a contract.
• Give accurate details and keep your password safe. You are responsible for activity on your account.
• If you create an account for a business, you confirm you are allowed to act for it.
• Tell us quickly at [email protected] if you think your account has been misused.

3. Your site and content

• You own the text, photos, prices and other content you add. You give us a licence to host, copy, resize and display it only to run the Service.
• You confirm you have the rights to everything you upload and that it is accurate, including prices, product descriptions and delivery promises.
• Our designs, software and brand remain ours. You may use our templates for your site while your account is active.
• Free sites show a small "Made with Brace Builder" link.

4. Acceptable use

You must not use the Service to:

• sell or promote anything illegal in Nigeria, including counterfeit goods, unlicensed financial or investment schemes, drugs or weapons;
• defraud, phish, impersonate others, or collect payment for goods or services you do not intend to provide;
• publish content that is hateful, harassing, sexually exploitative, or infringes someone else's rights;
• upload malware, attack our systems, or bypass limits or security.

We may remove content, suspend a site or close an account that breaks these rules, and report suspected crime to the authorities or to our payment partners.

5. Plans and billing

• Starter is free. Paid plans are billed monthly or yearly in Naira, in advance, through Monnify.
• Renewals. We remind you by email 7, 3 and 1 day before your renewal date, and by WhatsApp if you opt in.
• Automatic renewal is optional. If you tick "save my card and renew automatically" when paying by card, you authorise us to charge that card the plan price on each renewal date until you turn it off. You can turn it off in Billing at any time, and we then delete the saved card reference. If you do not opt in, or pay by transfer or USSD, you renew by link.
• If a renewal is not paid, your plan stays active for 7 days. After that your site moves to Starter and paid features switch off. Your content is kept.
• You can cancel any time. Your plan runs to the end of the period you paid for. We do not refund partial periods, except where the law requires or we decide to in a specific case.
• Changing plan starts a new period on the day you pay. We may change prices with at least 30 days' notice before your next renewal.

6. Selling with Brace Builder

On Pro and above you can take payments for orders. You are the seller: you are responsible for your products, prices, delivery, refunds to your customers, taxes and complying with consumer protection law.

Brace Builder payments

• We collect the buyer's payment through our Monnify account and Monnify settles your share to the bank account you confirmed. You receive the order amount including delivery.
• The buyer pays a processing fee of 2% of the order, capped at ₦2,500, shown at checkout before they pay.
• You must give us accurate payout details. We may ask for identity or business documents and may delay or limit payouts while we check suspicious activity.
• If a buyer disputes a payment or a chargeback succeeds, you agree to resolve it with the buyer and to repay us any amount we have to return, which we may deduct from future payouts.

Your own Monnify account

• Payments go directly to your Monnify account under your agreement with Monnify. We do not hold your money and charge no Brace Builder fee per order.
• You are responsible for your Monnify account, keys, settlements and disputes. We store your secret key encrypted and use it only to create and confirm payments for your site.

7. Domains

• Free sites use a bracebuilder.page address. We may reclaim an address that is misleading, abusive or unused for a long period.
• If you connect a domain you own, it stays yours. You keep it registered and its DNS records correct.

8. Ending your account

• You can delete your account by emailing us. We take your sites offline and delete your content within 30 days, except records we must keep by law (for example, payment records).
• We may suspend or close accounts that break these terms, put others at risk, or are unpaid, with notice where reasonable.

9. Liability

• We work hard to keep the Service available and secure, but provide it "as is" and cannot promise it will be uninterrupted or error free.
• We are not responsible for losses caused by your content, your products, third party services (such as Monnify, Cloudflare or your domain registrar), or events outside our reasonable control.
• To the extent the law allows, our total liability to you in any 12 months is limited to the fees you paid us in that period. Nothing in these terms limits liability that cannot be limited under Nigerian law.

10. General

• We may update these terms. For material changes we will tell you by email or in your dashboard at least 14 days before they apply.
• These terms are governed by the laws of the Federal Republic of Nigeria. Disputes will first be discussed in good faith, then go to the courts of Lagos State.
